DESCRIPTION: The Brigham City board of adjustment interprets city zoning ordinances and authorizes exceptions or variances to those ordinances in specific cases (Utah Code Annotated, 1953 10-9-6). Since zoning ordinances cannot provide for all conceivable situations, the board of adjustment is designed to temper the strict enforcement of the law while still maintaining its intent. It considers cases where exact application of an ordinance would be unduly restrictive. Individual appeals or requests are heard and evaluated by the board at monthly board meetings. The minutes for each meeting identify those present, and summarize the cases presented and the board's response. The most frequently repeated petitions presented to the Brigham City board of adjustment have been requests for variance from yard requirements for building construction. Other typical appeals include requests for variance from parking or sign requirements and requests for exception to zoning restrictions on doing business in residential areas.
