TITLE: Air quality administrative rules and public comment records

DESCRIPTION: This series documents the process the Division of Air Quality (DAQ) conducts in adopting a new administrative rule or changing an existing rule. The records for each new or amended administrative rule are compiled in accordance with UCA 63-46a-2(1)(1999). Information in the records include the title of the rule, the text of the rule, the rule analysis form published in the Utah State Bulletin, public comments received, the agency's analysis of the comments,and the agency's report of its decision making process. Because 40 CFR 51.102(d)(1999) requires that a public hearing be held and notice of the hearing be published in a newspaper thirty days prior to the hearing, records of rules established in accordance with the Clean Air Act also include the affidavit of the newspaper notice, the hearing roster, and DAQ's statement for the hearing. Summaries of any verbal comments made at the hearing are also placed in the files. Information in the files may also include audio tapes of hearings.
