This disposition is based on the administrative needs expressed by the care center. The Division of Health Care Financing maintains the record copy for 9 years and ORS maintains their copy for 5 years. 42 Code of Federal Regulations (CFR) 455 (1989) requires the state to investigate complaints of Medicaid fraud or abuse, but does not specify how far back in time the agency can investigate. According to the Denver Regional Office of the Federal Care Financing Agency, the government has 3 years in which to audit these records.
